Summary of the terms of service (English)
Based on the Czech terms valid from 6. 11. 2026, version 2026-11-06.
This is a short, non-binding summary for convenience. The legally binding text is the Czech terms of service (Obchodní podmínky). If the two differ, the Czech text prevails. The same applies to the privacy policy and the data processing agreement, which are available in Czech only.
Who provides the service
Atlayo Pay is operated by Atlayo Overseas s.r.o., company ID 29645433, VAT ID CZ29645433, registered office Příkop 843/4, Zábrdovice, 602 00 Brno, entered in the commercial register kept by the Regional Court in Brno, section C, file 152275. Contact: hola@atlayo.com.
Atlayo Pay is a technical service that lets online shops and other businesses accept card payments, Apple Pay and Google Pay. The payment services themselves are provided by Stripe Payments Europe, Ltd. (Ireland), supervised by the Central Bank of Ireland. Atlayo is not a bank or a payment institution and does not hold merchants' money. Takings sit in the merchant's Stripe account and Stripe sends them to the merchant's bank account.
Atlayo may allow only some payment methods for a particular gateway. In the Atlayo mobile app payments are made through Google Pay only. The customer then uses a card stored in their Google Pay and confirms the payment in Google Pay. Google's own terms apply to that service. Atlayo is not responsible for Google Pay and never sees or stores card numbers.
Who can use it
Only businesses, for their business activity. A merchant is not a consumer in relation to Atlayo, so consumer protection rules do not apply. Before live payments the company, the people who own or run it and the payout bank account must be verified by Stripe. Atlayo or Stripe may refuse verification or ask for more documents at any time. By accepting the terms the merchant also accepts the Stripe Connected Account Agreement.
Fees
- Standard European card: 2.9% + 9 CZK per successful payment.
- Premium and corporate card: 4.5% + 9 CZK.
- UK card: 4.1% + 9 CZK.
- Card issued outside Europe: 4.9% + 9 CZK.
- Payment in a currency other than the merchant's primary currency: 2% conversion surcharge; the fixed part is converted. The merchant sets the primary currency in the merchant details. It can only be a currency in which Stripe pays the merchant out without conversion, for merchants in Czechia the Czech koruna. Until the merchant sets it, the primary currency is the currency of the country of the merchant's seat.
- Bank dispute (chargeback): 550 CZK, or 23 EUR for merchants outside Czechia. Charged even if the merchant wins.
- Failed payments, monthly fee, activation and payouts: free.
The payment fee is deducted at the time of payment. The fee of the original payment is not returned on a refund. Fees may be changed with at least 30 days' notice.
Tax
Prices exclude tax. For merchants based in Czechia we add 21% tax to the fees. For VAT-registered merchants in another EU country we add no tax (reverse charge), and for merchants outside the EU we charge no Czech tax. A tax invoice for all fees is issued every month and is available in the app under Invoices.
Payouts
Payouts are free. Once at least 10,000 CZK (or the equivalent in another currency) is available, it is paid out automatically to the verified bank account. A smaller balance waits for more sales. The first payout is sent no earlier than 14 days after the first live payment. A payout may be held while a dispute, an unpaid debt, suspected fraud or a breach of the terms is open; the merchant is informed.
Refunds and disputes
The merchant is responsible for goods, services, complaints and refunds to its customers. A refund is deducted from the merchant's balance. When a customer disputes a payment with their bank, the disputed amount and the dispute fee are deducted from the balance, and the merchant can send evidence in the app. If the merchant wins, the disputed amount is returned. If the balance is not enough to cover a refund, dispute or fee, a debt to Atlayo arises; it is deducted from future takings and no payout is made until it is settled.
Merchant's duties
- Provide true and up-to-date information.
- Sell only legal goods and services that are not on the Stripe prohibited and restricted businesses list. Examples of what cannot be sold: counterfeit goods, drugs and drug paraphernalia, weapons and ammunition, gambling, betting and lotteries without a licence, adult content, financial services without authorisation, and pyramid or other fraudulent schemes.
- Publish its own terms, complaints procedure, contact details and clear prices including the currency.
- Never store card numbers; customers pay only in the Atlayo Pay checkout (secure Stripe field or a wallet such as Google Pay).
- Protect the secret API key and webhook signature, and replace them immediately if they leak.
- Not use the service for money laundering, fraud, card testing or circumventing card scheme rules.
Test mode
With a test key a merchant can try the checkout without real money. Test payments cost nothing, do not lead to payouts and are not part of the tax documents.
Suspension and termination
The merchant can end the contract at any time by closing the gateway in the app. Atlayo may terminate it with 30 days' notice, and may suspend payments or terminate immediately in case of a material breach, suspected fraud or a Stripe decision.
Changes, governing law and contact
We may change the terms and the price list with at least 30 days' notice in the app or by e-mail. A merchant who disagrees can terminate the contract before the change takes effect. The contract is governed by Czech law and disputes are decided by the general courts of the Czech Republic. Questions: hola@atlayo.com.
